These Terms of Service ("Terms") govern your use of the Ambience macOS application ("App") and the website ambience-app.com ("Website"), operated by Ambience ("we," "us," or "our"). By accessing or using our App or Website, you agree to be bound by these Terms.
1. Acceptance of Terms
By downloading, installing, or using the App, or by accessing the Website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the App or Website.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control, subject to the Apple Media Services Terms and Conditions. This license does not allow you to:
- Distribute, sublicense, or resell the App.
- Reverse-engineer, decompile, or disassemble the App.
- Remove or alter any proprietary notices or labels in the App.
- Use the App for any unlawful purpose.
3. App Store
The App is made available through the Apple App Store. Your use of the App is also subject to the Apple Media Services Terms and Conditions. In the event of a conflict between these Terms and the Apple terms, the Apple terms shall govern with respect to your use of the App.
4. Updates
We may release updates to the App from time to time. Updates may add, modify, or remove features. We are not obligated to provide any updates or to maintain backward compatibility. Continued use of the App after an update constitutes acceptance of any changes.
5. Intellectual Property
All content, design, graphics, visual effects, code, and other materials in the App and on the Website are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or distribute any of these materials without our written permission.
6. User Conduct
You agree not to:
- Use the App or Website in any way that violates applicable laws or regulations.
- Attempt to gain unauthorized access to any part of the App, Website, or related systems.
- Interfere with or disrupt the operation of the App or Website.
- Use automated tools to scrape, crawl, or extract data from the Website.
7. Disclaimer of Warranties
The App and Website are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
8. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the App or Website, even if we have been advised of the possibility of such damages.
9. Termination
We may terminate or suspend your access to the App or Website at any time, without prior notice, for any reason, including if you breach these Terms. Upon termination, your license to use the App is immediately revoked.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the App or Website after changes are posted constitutes your acceptance of the revised Terms.
